TERMS OF USE — THEBLOODAPP
Effective Date: 1st December 2025
This document is an electronic record under the Information Technology Act, 2000 and is published in accordance with Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011. It does not require physical or digital signatures.
By accessing or using TheBloodApp ("App"), You ("User") agree to these Terms of Use ("Terms"). If You do not agree, You must stop using the App immediately.
DEFINITIONS
For the purposes of these Terms:
"User", "You", "Your": Any individual accessing or using the App.
"Donor": A User who volunteers to donate blood.
"Receiver": A User who submits a request for blood for themselves or another person.
"We", "Us", "Our": The owner/operator of TheBloodApp.
"Service" or "Feature": The blood donation matching system and all related features provided through the App.
PURPOSE OF THE FEATURE
TheBloodApp enables Users who wish to donate blood ("Donors") to connect with individuals who require blood ("Receivers").
The App matches Donors and Receivers based on geographical proximity and User-provided information.
THEBLOODAPP IS NOT A BLOOD BANK
TheBloodApp is not a blood bank, medical facility, or healthcare provider.
- We do not recruit, select, screen, test, collect, store, process, or transport blood.
- We do not participate in any medical, diagnostic, or clinical activity related to blood donation.
- We hold no licenses, approvals, registrations, or certifications applicable to blood banks or healthcare service providers under any Indian or international law ("Applicable Law").
ROLE OF THEBLOODAPP
- TheBloodApp only provides a technology platform to connect Donors and Receivers.
- TheBloodApp is not involved in medical supervision, blood donation procedures, or blood transfusion arrangements.
- TheBloodApp does not guarantee that a Donor will agree to donate or that a Receiver will receive blood.
- No contract, express or implied, is created between Donors, Receivers, or TheBloodApp through use of the App.
VOLUNTARY NATURE OF BLOOD DONATION
- Blood donation is entirely voluntary.
- Donors may withdraw or change their donor status at any time through their App profile.
- TheBloodApp does not guarantee availability, willingness, or compatibility of any Donor.
- TheBloodApp is not liable for lack of response, delayed response, or unsuccessful matches.
NO MEDICAL RELATIONSHIP
- TheBloodApp does not provide medical advice, checks, or evaluations.
- Donors must independently verify their health eligibility for donating blood.
- Receivers must rely on hospitals, blood banks, or qualified medical professionals for all medical decisions.
- TheBloodApp is not responsible for any User's medical condition, complications, or treatment outcomes.
ACCURACY & VERIFICATION OF INFORMATION
- Information displayed on the App (Donor details, Receiver details, requests, etc.) is provided solely by Users.
- TheBloodApp does not verify the authenticity, accuracy, or completeness of any User-submitted information.
- Donors and Receivers must independently verify all necessary details with their respective hospitals or blood banks before proceeding.
NO ACCESS TO HEALTH RECORDS
- TheBloodApp does not access, store, request, or handle medical records or protected health information of Users.
- Any eligibility checks or medical evaluations remain the sole responsibility of the Users and their healthcare providers.
LIMITATION OF LIABILITY
To the maximum extent permitted by Applicable Law:
TheBloodApp is not liable for:
- loss of life, injury, medical complications, or adverse events resulting from blood donation or interactions facilitated through the App
- inaccurate or false information posted by Users
- delay or failure in connecting Donors and Receivers
- actions, omissions, or misconduct of Users or third parties
- loss of personal data due to factors beyond Our reasonable control
- fraud, misuse, impersonation, or identity issues caused by Users
Users interact with each other at their own risk.
NO FEES FOR BLOOD DONATION
- TheBloodApp does not charge any fee from Donors or Receivers for blood donation.
- TheBloodApp does not allow incentives, payments, or rewards in exchange for blood donation.
- Any such attempt by a User may lead to suspension or permanent removal from the App.
NO PROMOTION OR ENDORSEMENT
- TheBloodApp does not endorse, promote, or recommend any treatment, remedy, drug, hospital, blood bank, or healthcare provider.
- The Feature is strictly for connecting volunteer Donors with Receivers.
USE OF THE FEATURE
While using the App, Users are also bound by:
- TheBloodApp's Privacy Policy
- Community Guidelines (if applicable)
- Any other supplemental policies or notices
In case of conflict between these Terms and other policies, these Terms shall prevail.
CONTENT & USE LIMITATIONS
- Any information received through the App must only be used for the purpose of blood donation.
- Users must not misuse contact details or personal information displayed in the App.
- Any harassment, extortion, abuse, or unethical activity may lead to immediate termination of access.
RIGHT TO MODIFY OR TERMINATE ACCESS
- TheBloodApp may suspend, restrict, or terminate any User's access to the App at any time for any reason, including violation of these Terms or misuse of the platform.
- TheBloodApp may modify, update, or discontinue the Feature without prior notice.
DONOR-SPECIFIC TERMS
By registering as a Donor:
- You voluntarily express an interest in donating blood.
- You agree to receive notifications when a Receiver near you raises a blood request.
- You may retract your donor status anytime.
- You understand that Your eligibility must be confirmed by medical professionals, not TheBloodApp.
- You understand that the hospital or blood bank determines final acceptance for donation.
RECEIVER-SPECIFIC TERMS
By submitting a blood request:
- You confirm that the request is genuine and lawful.
- You agree to verify Donor identity and medical compatibility through a licensed hospital or blood bank.
- You are responsible for evaluating Donors' authenticity and suitability.
COMMUNITY CONTENT TERMS
If you upload images or posts in community features:
- You are solely responsible for Your content.
- You must not upload harmful, fraudulent, offensive, or illegal content.
- TheBloodApp may moderate, remove, or restrict content that violates policies.
CHILDREN'S USE
- Users under 18 may only submit blood requests.
- They cannot register as Donors.
- Parents/guardians are responsible for supervising minor Users.
INDEMNITY
You agree to indemnify and hold harmless TheBloodApp from any claims, damages, losses, or liabilities arising from:
- Your use of the App
- Your interactions with Donors, Receivers, or third parties
- Violation of these Terms
- Misuse of information obtained from the App
CHANGES TO THESE TERMS
TheBloodApp may update these Terms at any time.
Continued use of the App constitutes acceptance of the updated Terms.
